1. Acknowledgement

This agreement is between you and AixceLabs, not Apple. AixceLabs is solely responsible for the licensed application and its content.

2. Scope of License

The license granted to you for Memryze is non-transferable and limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

3. Maintenance and Support

AixceLabs is solely responsible for providing maintenance and support services for Memryze. Apple has no obligation to furnish any maintenance or support services for the app.

4. Warranty

To the extent any warranty exists and is not effectively disclaimed under applicable law, AixceLabs is solely responsible for warranty obligations. If Memryze fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price where applicable. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

5. Product Claims

AixceLabs, not Apple, is responsible for addressing claims relating to Memryze or your possession and use of Memryze, including product liability claims, claims of legal or regulatory non-compliance, and claims under consumer protection, privacy, or similar legislation.

6. Intellectual Property Claims

In the event of a third-party claim that Memryze or your use of Memryze infringes that third party's intellectual property rights, AixceLabs, not Apple, will be solely responsible for investigation, defense, settlement, and discharge of such claim.

7. Legal Compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Terms

You must comply with applicable third-party terms when using Memryze.

9. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this addendum and, upon your acceptance of these terms, Apple will have the right to enforce this addendum against you.
